Accuracy

We attempt to ensure that the contents of the The Wool Shed website and online store are accurate and current at the time they are published. Prices and charges displayed on the Website are current at the time of display and are subject to variation without notice. We attempt to be accurate as possible with our descriptions and information. However, we are unable to warrant that product descriptions or other content of the website is accurate, complete, reliable, current or error free.

Liability

It is a condition of the person/s accessing, browsing and/or using the The Wool Shed website, [“You”, “Your”] that You accept that We will not be liable under any circumstances for any action you take relying on the information on this Website or using any service which is accessible using this Website. 

You expressly agree that your use of the The Wool Shed Website is at your own risk. The contents of the website and any linked sites are provided for information purposes and convenience only and are not intended for professional advice.

We exclude all liability whether in contract, tort (including liability for negligence) or otherwise for the accuracy, suitability, quality or completeness of any content or goods and services, available on or through using the The Wool Shed website.

We make no warranties that the website and any linked sites are free of infection by computer viruses or other contaminations and accept no responsibility for any such viruses or other contaminations.

You agree to indemnify The Wool Shed ‘Us’, its affiliates, employees, agents, contributors, third party content providers and licensors from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with, directly or indirectly, your use of the use of the Website and/or breach of these Terms.

Invalidity

If any part of this agreement is deemed invalid, that part will be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

Privacy

We take your privacy seriously and any information provided through your use of the Website and/or content are subject to our Privacy Policy, which is available on the Website.

Termination of Contract

You acknowledge and agree that these Terms and your access to this Site may be terminated at any time by us without notice for any reason, including, without limitation, if we believe that you have violated or acted inconsistently with the letter or spirit of these Terms. All clauses in these Terms which are stated or intended to continue after termination will continue to apply. The Wool Shed, ‘Us’ will not be liable to you or any third party for any termination of your access to this Site.

No material from this website may be reproduced, broadcast, communicated or copied (other than as defined in the Australian Copyright Act 1968) without first obtaining permission from us.  

We reserve the right to vary, review and change any of the terms and conditions by updating this page at our sole discretion. Any changes to the terms and conditions take immediate effect from the date of their publication.  A copy of our current Terms and Conditions is displayed on the website at all times.

Booking Terms and Conditions 

The Wool Shed, www.thewoolshednsw.com operated by H D DIXON & S TOHOW (ABN:36 372 138 724) [“We”, “Us”, “Our”, “Property”, “The Wool Shed”] is located at 3219 Towamba Road Burragate NSW 2550. 

By making a booking for our Services through our website to visit The Wool Shed, You [“You”, “Visitor(s)”,“Attendees”] are agreeing to the terms and conditions set out below and they will form the contract between us (Terms and Conditions)

When we say the “Services” in these Terms and Conditions, we mean our farm experiences and any additional services we may provide and that you may place a booking for. We have also used a few other capitalised words and phrases as shorthand to refer to recurring concepts. Each of these are defined in bold and in brackets after the concepts are first mentioned.

Before you book in for any of our Services, please carefully read these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not book in for any Services. By clicking “accept” when you create an account, or otherwise proceed to book in, or attend, any Services, you agree to be bound by these Terms and Conditions. You may also additionally accept the Terms and Conditions by clicking/ selecting to accept or agree to the Terms and Conditions where this option is made available to you when booking. You will ensure that any other person you are booking on behalf of, shall also comply with these Terms and Conditions.

If you are agreeing to these Terms and Conditions on behalf of someone, you represent and warrant that that you have the irrevocable authority and agreement of that person to be bound by these Terms and Conditions.   

Payment 

All prices are quoted in Australian dollars inclusive of GST (unless where expressly stated otherwise) and are subject to change at any time. 

Any changes to prices made after purchasing and confirmation will not affect your booking. All payments must be made in full at the time of completing the registration form and in any event prior to the date of the visit to the property.

A credit card fee may apply to credit card transactions.

Credit card payments are processed using a secure, third-party payment gateway service called Stripe. Credit card details are encrypted and cannot be accessed by us.

We reserve the right to run price promotions as we think fit.

Cancellations and refunds

Tickets are non-refundable. If you find yourself unable to attend the event, you may transfer your ticket(s) to friends or family. Please make contact with us in writing to update your ticket to someone else in case you cannot make it.

If in the unlikely circumstance, we need to cancel a booking, dependent on the situation the booking will be postponed (and a credit given) to a future event, or a refund provided within a reasonable time frame. 

Nothing in this Agreement purports to limit, restrict or exclude any rights available to you under the Australian Consumer Law that cannot be limited, restricted or excluded.

Accessing our Property 

You may be granted access to our Property for the Services. 

  You understand that your access to the Property is contingent upon your compliance with our instructions and guidelines regarding the use of the Property. Failure to comply with our instructions, guidelines, or any applicable laws or regulations may result in the immediate revocation of your access to the Property.

You agree to indemnify and hold The Wood Shed harmless from any breach of our instructions or guidelines, as well as from any damage, loss, injury, or liability incurred as a result of the your actions or negligence while accessing the Property.

You acknowledge and agree that you are solely responsible for your own actions and conduct while on the Property and will exercise reasonable care while on the Property to prevent any damage or harm to the Property, property, or individuals present. You will be responsible for any damage caused to the Property, property, or individuals as a result of your failure to exercise reasonable care.

We reserve the right to terminate your access to the Property at any time and for any reason, including but not limited to non-compliance with instructions or guidelines, breach of this clause, or as deemed necessary for the safety, security, or proper functioning of the Property.

Waiver 

Visiting our Property and participating in farm educational, leisure activities and other Services when you make a booking with us involves inherent risks including but not limited to serious injury, death, or accidents to children and adults. You and any other person you are booking on behalf of, accept and acknowledge the inherent risks of visiting The Wool Shed, 3219 Towamba Road Burragate 2550 New South Wales, on primary production, working farm.  You attend at your own risk. By making a booking, you acknowledge and agree that all risks associated with such activities and our Services are your sole responsibility. 

We do not encourage people aged 18 years and under to visit the Wool Shed. Minors under the age of 18 who attend do so at the Parent and or Guardians’ risk. Parents and Guardians must actively supervise children at all times, We are unable to ensure your child’s safety on the property and we cannot supervise children on your behalf. We reserve the right to ask any minor and their parent and or guardian to leave the property at any point of the visit with no refund provided. 

You acknowledge the following risks and agree to comply with our instructions regarding the following points: 

  • Farm animals can carry diseases, and proper handwashing is essential after interacting with animals. Always follow the handwashing instructions provided by us. 

  • Farm animals can act in sudden and unpredictable ways, especially if frightened or hurt. Avoid direct approaches to animals in paddocks.

  • Do not enter any fenced area without express permission from us. 

  • Stay out of clearly marked out-of-bounds areas.

  • Farm equipment is dangerous; do not climb or play on it.

You agree that you have read, understood, and agree to the risks inherent in participating in our Services at The Wool Shed. By placing a booking and attending such Services, you agree that you will hold harmless The Wool Shed, and their directors, employees, partners, volunteers, for any personal injury, death, loss, or damage to you or your possessions arising from your participation in these Services. This release includes any liability arising from any express or implied terms, common law, or any other way.

Liability and Indemnity

To the maximum extent permitted by applicable law, The Wool Shed limits all liability in aggregate of all claims to you (and any third parties who encounter the services or goods through you) for loss or damage of any kind, however arising whether in contract, tort (including negligence), statute, equity, indemnity or otherwise, arising from or relating in any way to these Terms and Conditions or any goods or Services provided by The Wool Shed, to any amounts paid by you to the Wool Shed in the 6 months preceding the date of the event giving rise to the relevant liability.

All other express or implied representations and warranties in relation to Services and the associated services performed by The Wool Shed are, to the maximum extent permitted by applicable law, excluded.

Nothing in this agreement is intended to limit the operation of the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) (ACL). Under the ACL, you may be entitled to certain remedies (like a refund, replacement or repair) if there is a failure with the goods or services we provide.

You indemnify The Wool Shed and its employee, contractors and agents in respect of all liability for any claim(s) by any person (including any third party who encounter the services through you) arising from your or your representatives:

  1. breach of any of these Terms and Conditions;

  2. any delay in providing you with any service; 

  3. attending the Property; 

  4. any act, omission, communication, inaccuracy or error in relation to the provision of the Services; 

  5. negligent, wilful, fraudulent or criminal act or omission; or

  6. use of any goods or Services (including the Services) provided by The Wool Shed.

To the maximum extent permitted by law, under no circumstances will The Wool Shed be liable for any incidental, special or consequential loss or damages, in connection with these Terms and Conditions or any Services or services provided by The Wool Shed (except to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth)).

To the full extent permitted by any applicable law, we make no representation, warranty or guarantee regarding the reliability, timeliness, quality, suitability or availability of any goods or services when you visit the Wool Shed, or that any event at The Wool Shed will be uninterrupted or error-free.

Digital media release 

You consent to the use of your picture(s) and/or videos taken in connection with the Services without payment of any compensation, on our website, Facebook page or in any editorial, promotional or advertising material produced and/or published by The Wool Shed both online and/or in print. 

If you do not wish to allow the use of these picture(s) and videos, you must notify The Wool Shed in writing prior to attending the booking for the Services.

Damage

Any damage to the property or damage to items within the property must be reported to us at the time of damage. After you leave the property, we will inspect the property to identify evidence of damage or theft. We reserve our right to charge for any damage to the property or theft of property during your visit. 

If any damage to the property or theft of the property is identified after your visit, you will be notified of such damage in writing and we will issue an invoice addressed to you for repair or replacement costs. You must attend to payment of the invoice within fourteen (14) days from the date received. 

Responsible Service of Alcohol 

It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of a person under the age of 18 years. The Wool Shed (H D DIXON & S TOHOW) supports the Responsible Service of Alcohol.
